WHEN:             

Conditional Uses are uses which are not permissible by right in certain Zoning Districts but which may be permitted by the terms of the Kenosha County General Zoning & Shoreland/Floodplain Zoning Ordinance if certain conditions are met.

 

WHY:     

Certain uses, although not inherently inconsistent with the use classification of a particular district, could create special problems and hazards if allowed to develop and locate as a matter of right in a particular district and therefore is in need of special consideration.  A conditional use is designed to be a flexibility device designed to cope with these situations.

 

HOW:               

A pre-conference is required with County Development Staff prior to submitting your request for a conditional use.  Staff will review your proposed development and discuss the development process.  A conditional use is a request letter that you put together based upon the procedures described in the Kenosha County General Zoning & Shoreland/Floodplain Zoning Ordinance. Pre-conferences are usually attended by Town officials to assure the request is compatible with Town adopted Land Use Plans.  We consider zoning a partnership with the Towns.

You must submit a complete conditional use request and the appropriate fee based upon the Kenosha County Department of Planning & Development Fee Schedule.

TIME:                

You can anticipate that the conditional use process will take approximately four (4) to eight (8) weeks upon submittal of a completed petition.  Please keep in mind that this process may take longer if your rezoning petition is tabled at the Town level and/or if additional information becomes necessary.
